Welcome to NurtureField S.A. ("NurtureField", "we", "our"). These Terms and Conditions ("Terms") govern your access to and use of our platform, including the website [nurturefield.com], mobile applications, and any related services provided by NurtureField (collectively, the "Services"). By using our Services, you agree to comply with and be legally bound by these Terms. If you do not agree to these Terms, you should not access or use our Services.

1. ACCEPTANCE OF TERMS

By accessing or using our Services, you confirm that:

2. DESCRIPTION OF SERVICES

NurtureField reserves the right to modify or discontinue any part of the Services at any time without notice.

3. USER ACCOUNTS

To access certain features of the Services, you must create an account:

  3. You agree to notify NurtureField immediately of any unauthorized use of your account.

You agree not to misuse the Services, including but not limited to:

  1. Engaging in illegal activities.

    a) Uploading malicious software or content

    b) Attempting to gain unauthorized access to the Services.

  2. You are solely responsible for the accuracy and legality of any data or content you provide through the Services.

6. PRIVACY

Our collection and use of personal information are governed by our Privacy Policy at https://www.nurturefield.com/privacy-policy. By using the Services, you consent to the collection and use of your data as described in the Privacy Policy.

7. FEES AND PAYMENTS

Certain features of the Services may require payment of fees. Applicable fees will be displayed at the time of purchase or subscription. All fees are non-refundable unless otherwise stated.

8. SERVICE AVAILABILITY

NurtureField strives to ensure uninterrupted availability of the Services but does not guarantee that the Services will always be available or error-free. Maintenance, updates, or unforeseen circumstances may result in temporary downtime.

9. DISCLAIMER OF WARRANTIES

The Services are provided "as is" without warranties of any kind, whether express or implied. NurtureField does not guarantee the accuracy or reliability of data provided through the Services.

10. LIMITATION OF LIABILITY

To the maximum extent permitted by law, NurtureField will not be liable for any indirect, incidental, or consequential damages arising from the use of the Services. NurtureField's total liability for direct damages will not exceed the fees paid by the user in the six months preceding the claim.

11. INDEMNIFICATION

You agree to indemnify and hold harmless NurtureField, its affiliates, and employees from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

12. LIMITATION OF LIABILITY FOR DATA AND RECOMMENDATIONS

NurtureField provides data and recommendations based on information collected through its sensors, proprietary sources, and algorithms. However:

  1. Data Accuracy: While we strive to ensure the accuracy and quality of the data and recommendations provided, we cannot guarantee their completeness, accuracy, or suitability for specific purposes.

  2. Limited Responsibility: NurtureField is not responsible for:

    a) Agricultural or management decisions made by users based on the data or recommendations provided.

    b) Any direct or indirect impact on crops, soils, equipment, materials, or other user assets resulting from the implementation of such recommendations.

  3. User Responsibility: The user agrees that:

    a) The information provided by the platform should be used as a supplement, not a substitute, for their own analysis, experience, and professional judgment.

    b) It is the user's sole responsibility to evaluate the relevance, accuracy, and applicability of the data provided for their specific circumstances.

13. GOVERNING LAW

These Terms are governed by the laws of Uruguay. Any disputes arising under these Terms will be resolved exclusively in the courts of Montevideo, Uruguay.

14. CHANGES TO THE TERMS

NurtureField may update these Terms periodically. Changes will take effect immediately upon posting on the App. Continued use of the App constitutes acceptance of the revised terms.
